Environmental Violations Administrative Monetary Penalties Act

Purpose

To establish a fair and efficient system of administrative monetary penalties (AMPs) for the enforcement of various environmental statutes.

Reson for Hearing

An AMP may be issued by an enforcement officer for prescribed violations of the following statutes and their regulations:

  • Antarctic Environmental Protection Act
  • Canada Wildlife Act
  • Canadian Environmental Protection Act 1999
  • Greenhouse Gas Pollution Pricing Act
  • International River Improvements Act
  • Migratory Birds Convention Act 1994
  • Wild Animal and Plant Protection and Regulation of International and Interprovincial Trade Act.

Where an AMP (notice of violation) has been issued, the person, ship or vessel to whom the AMP was directed may request a review (s. 15 of EVAMPA).

Review Officer's Role

The Review Officer shall determine whether the person, ship or vessel committed a violation and/or correct the amount of the AMP if it was not determined in accordance with the regulations (s. 20 of EVAMPA).

Next Steps

Except for judicial review under the Federal Courts Act, there is no appeal or review of the Review Officer’s determination (s. 23 of EVAMPA).
